I graduated from the University of Miami Law School, cum laude (top 10% of my class), in 1989 and I've been a practicing trial lawyer for over 27 years. I started my career as an Assistant State Attorney working for Janet Reno in the Miami-Dade County State Attorney’s Office where I prosecuted everything from DUIs to Traffic Homicide, Armed Robbery and Murder cases. I have had extensive experience in the DUI Traffic Homicide Division where we worked on many cases involving traffic crash analysis and accident reconstruction. I was also the first prosecutor in Dade County’s newly formed Drug Court. As an Assistant State Attorney and legal intern before that, I tried over 47 jury trials before I went into private practice in 1991. Since that date, my primary area of practice has been Personal Injury where I have handled hundreds of cases through settlement or Jury Trial. I spent 1991 through 1997 working with other law firms handling Jury Trials and Settlements of major personal injury claims. I also represented clients in Criminal matters and assisted families who had a loved one in need of treatment due to drug or alcohol addiction. In 1998 I opened my own practice because I saw how frustrating and ineffective it was for injured clients, when they tried to talk to their lawyer in a typical multi-lawyer law office. Many times they had to deal with a different attorney every time they called. It was then that I realized that I wanted to create a firm that attracted clients who preferred to have one lawyer handling their case who is reachable, accountable and reliable. That means a lawyer who returns phone calls, does not share responsibility (or blame) for the client’s file with any other lawyers and fights for the best result possible for his or her clients. I work with an amazing support staff but have chosen to always be the only lawyer in the office. I am personally responsible for insuring the best outcome possible for all my clients. I have tried to make personal attention to my clients my theme over the past two decades. All my clients get my cell phone number and I am always available for conference calls or in person meetings with clients as often as they desire and for whatever reason they desire. I have been involved in thousands of personal injury cases since the early 1990’s including successful jury trials and settlements with all the major insurance companies. I have also handled many criminal defense cases and Marchman Act claims for families who need help forcing a loved one into treatment for a drug or alcohol addiction. I am active with various Bar Associations and have maintained an excellent working relationship with other lawyers, judges, doctors and other health professionals who treat my clients. Areas of practice are: Vehicle Accidents Slip and Fall Brain Injury / Spinal Cord Injury Victims of Violent Crimes Medical Malpractice / Workers Comp. Dog Bite Accident Nursing Home Abuse Electrical Accident / Burn Injuries Insurance Disputes Defective Products Criminal Defense Marchman Act Involuntary Hospitalization Since becoming a lawyer in 1989 I have handled cases involving the following types of accidents or injuries: I handle all of my cases personally and have been doing so out of my Plantation Office since 1998. I opened an office in Naples, Florida in 2004. What differentiates me from my competitors is that I personally meet with all clients and give all clients my cell phone number so they can reach me on nights and weekends, if necessary. All of my clients receive personal attention and I do not refer my cases to any other lawyers if they do not settle. I try all my own cases and have obtained millions of dollars in jury verdicts over the years. I am currently accepting cases throughout the state of Florida.

This includes incidents occurring on ocean, inland, and coastal navigable waterways on vessels such as cruise ships, yachts, ferries, and fish boats. Maritime law can trace its roots back to 1920, when Congress passed a measure to protect workers injured at sea called the Jones Act. Today, the protective provisions of the Jones Act have been expanded to include anyone who is injured on open water, including: Cruise ship passengers Merchant marines Cruise ship employees Harbor or dock workers Ferry passengers Offshore oil workers Yacht guests Commercial fishermen Passengers on crashed airplanes Any kind of worker on a commercial sea vessel After falling victim to an accident, injury, or crime at sea or other body of water, families and individuals can fight to protect their rights in court. What should you look for in a cruise ship accident law firm? We believe that any good personal injury firm will offer you both the compassion and professionalism you need during this difficult time in your life. The members of your legal team should also communicate well with each other and with you, so that you understand what’s happening with your case every step of the way. You should be able to easily contact the firm when you need legal counsel or have questions about specific aspects of your case, and they should be able to provide you with clear answers and sound advice. And, of course, the lawyers at the firm need to be well-versed in the intricacies of maritime law and cruise ship accident cases so that they can provide you with the best possible chance of winning your case and getting the compensation that you deserve. The Law Office of Andrew Winston prides itself on striving to meet or exceed all those qualifications. Our talented team members are passionate about serving clients who have suffered cruise ship injuries and all our partners – as well as Of Counsel Mark J. Leeds – are qualified to practice maritime law in Florida. In fact, we collectively have more than 70 years experience handling cruise ship injury cases just like yours. We know that cruise lines have a duty of care to both their passengers and crew, and if they fail to live up to that standard, they need to be held accountable. We have experience in cases against popular cruise lines like: Carnival Disney Royal Caribbean Princess Cruises Holland America Norwegian MSC We, also, handle many other types of cases, and you can obtain more information about our practice by contact the Law Office of Andrew Winston What kind of injuries can you suffer on a cruise? Essentially all the same injuries you can suffer on land, but with added risks because passengers and crew members are exposed to risk factors that they would not face at home. Accidents that have occurred on cruises include: Slip and falls. Wet decks and tripping hazards in high-traffic areas can cause passengers to fall and injure themselves. The narrow staircases on some cruise ships can also pose a risk, and those who fall may suffer brain trauma, a back or neck injury, spinal cord injury, broken bones, or internal bleeding. Shore excursion accidents. Cruise lines often claim that there are inherent risks to shore excursions and that passengers must assume responsibility for accidents, but there are situations where the cruise line itself may be at fault. If crew members fail to inspect equipment, follow activity regulations, or warn passengers about the potential risks of cruise-sponsored shore excursions, like ziplining or parasailing, the cruise line may be liable for any accident that occurs. Medical negligence. The medical attention you receive on a cruise ship is not going to be the same you receive in a hospital, and some cruise lines don’t even require that their doctors be licensed to practice medicine in the United States. Furthermore, cruise line infirmaries often lack the staff and resources to give all sick or injured passengers the attention they need. It’s all too easy for a harried ship doctor to misdiagnose a problem, which can lead to serious complications for you. Norovirus. This virus that causes gastrointestinal distress spreads easily from person-to-person, can survive outside of a host for three weeks or more, and is increasingly becoming a problem for cruise ships. Norovirus outbreaks in early 2014 infected hundreds of people aboard at least three different ships, forcing the ships to return to port early after sick passengers overwhelmed the infirmary and made each ship an unsanitary environment.
