Welcome to LocationsNear.Me. These Terms of Service ("Terms") govern your access to and use of the website at locationsnear.me (the "Service"), operated by LocationsNear.Me ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. The Service

LocationsNear.Me is an online directory that helps users find local businesses in the United States. Listings include information such as business names, addresses, phone numbers, websites, hours, and categories, compiled from public sources, data partners, business owners, and user submissions.

2. Accuracy of Information — No Warranty

Directory information is provided for general reference only. Business details change frequently — locations close, move, change hours, or change phone numbers — and we cannot guarantee that any listing is accurate, complete, or current. Always verify critical details (such as hours, addresses, or availability) directly with the business before visiting or relying on them. We are not responsible for any loss or inconvenience arising from inaccurate listing data.

3. User Submissions

You may submit new listings, corrections, or updates. By submitting content you represent that it is accurate to the best of your knowledge and that you have the right to share it. You grant us a perpetual, royalty-free license to use, edit, publish, and redistribute submitted content as part of the directory. We may accept, reject, edit, or remove any submission at our sole discretion and are not obligated to publish or retain any content.

You agree not to submit content that:

• Is false, deceptive, defamatory, or misleading;
• Infringes any intellectual-property, privacy, or publicity right;
• Contains malware, spam, or promotional material unrelated to a legitimate business listing;
• Is unlawful or promotes unlawful activity.

4. Business Owner Subscriptions

• Plans and billing — paid plans (such as Verified and Featured) are billed monthly or annually through our payment processor, Stripe. Prices are shown at checkout.
• Free trials — where offered, you will not be charged until the trial ends. Cancel before the trial ends to avoid charges.
• Cancellation — you may cancel at any time via the billing portal. Your plan benefits continue until the end of the current billing period, after which the listing reverts to the free tier. We do not provide prorated refunds for partial billing periods.
• Verification — claiming a listing requires demonstrating a legitimate connection to the business. We may reverse a claim made in bad faith.
• Changes — we may adjust plan pricing or features with notice; changes take effect at your next renewal.

5. Acceptable Use

You agree not to:

• Scrape, harvest, or bulk-download directory data without our prior written consent;
• Use the Service to send unsolicited marketing to listed businesses;
• Interfere with the operation of the Service, including by circumventing rate limits or security measures;
• Misrepresent your affiliation with any business or person.

6. Advertising

The Service is supported by advertising, including ads served by third parties such as Google AdSense. Advertisers are solely responsible for the content of their ads. The presence of an ad does not constitute our endorsement of the advertised product or service. See our Privacy Policy for details on advertising cookies and how to opt out of personalized ads.

7. Intellectual Property

The Service, including its design, software, and the compilation and arrangement of directory data, is owned by us or our licensors and protected by applicable law. Business names and trademarks shown in listings belong to their respective owners; their appearance in the directory does not imply affiliation with or endorsement by those owners.

8. Third-Party Links

Listings and pages may link to third-party websites (such as business websites or map providers). We do not control and are not responsible for the content or practices of third-party sites.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from content you submit or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service (including business owner accounts) if you violate these Terms. You may stop using the Service at any time; paid subscriptions are governed by the cancellation terms in Section 4.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in Harris County, Texas.

14. Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date above reflects the most recent revision. Material changes will be indicated by updating that date; continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
